The following page states the "Terms & Conditions" under which Advertisers (identified as “the Advertisers”) may use the Vocation H (“Vocation H”) (ABN 57 449 019 763) website (“Site”). Please read this page carefully before accessing or using the information and services available through the Site. Advertising Terms & Conditions must be accepted and adhered to by all Advertisers who use Vocation H’s services. By accessing or using the Site, you agree to be bound by the Terms & Conditions set out below.

ADVERTISERS

Advertisers on www.vocationh.com.au ("Site") agree to be bound by the following terms and conditions.

  1. In order to use the site, Advertisers must be registered members of Vocation H.
  2. To register Advertisers must provide Vocation H with valid company/business information as requested on the Vocation H registration form. Additionally, Advertisers must provide the contact details of at least one person who will be considered the representative of the registered company/ business for all correspondence with Vocation H.
  3. All individuals registering company/business details with Vocation H hereby state that they have lawful authority and permission to act on behalf of the company/business for which they are registering. Registered Advertisers shall be given a Vocation H member’s account for which they must select a username and password.
  4. Advertisers are solely responsible for the security of their user name and password and for all activity of their account. Advertisers agree to accept responsibility for all activities that occur via their account or password. Vocation H will not be liable for any misuse of Advertisers member accounts.
  5. Advertisers may change their password or login at any time via there Account Homepage.
  6. Advertisers agree to immediately notify Vocation H of any unauthorized use of their login name or of any other breach of security.
  7. Vocation H has two categories of job advertisements that may be posted by Advertisers:

    Single Ad Rate Advertisements
    7.1 Ads placed as single ad rate advertisements are charged at the single ad rate as displayed on the site at the time of posting and are subject to the advertising conditions outlined on the site at that time.
    7.2 Please note it is the Advertisers’ responsibility to check the price and conditions of single ad rate advertisements prior to posting on the site.
     
    Job Package Advertisements
    7.3 Advertisers may purchase Vocation H job packages via the job packages link on their account homepage. The price, features and conditions of each Vocation H job package are fully detailed and displayed in the job package information section of the site.
    7.4 Upon confirmation of purchase of a job package, Advertisers will be given a package confirmation code to use when posting ads that are part of a purchased job package.
    7.5 Jobs posted as part of a purchased job ad package are not subject to individual charges (i.e. they are not considered job postings to be charged at the single ad rate).
    7.6 Jobs ads purchased as part of a Vocation H job package must be used within six months of the date of purchase. Any unused ads will be forfeited after this time.
    7.7 Advertisers are solely responsible for the use and security of the confirmation code given to them at the time of purchase of job packages. Vocation H will not be liable for any misuse of confirmation codes or individual ads belonging to job packages.

  8. All posted job ads stay active for a maximum of thirty days (from the date of posting).
  9. Advertisers wishing to renew an already posted job ad must repost the ad (such reposting is subject to appropriate charges).
  10. Advertisers may remove a posted ad at any time prior to the thirty day expiry deadline. If an ad is removed prior to the thirty day expiry date, the ad is considered expired.
  11. Advertisers who repost a removed ad will be subject to appropriate charges and the reposted ad will be considered a new job ad posting.
  12. Advertisers may request from Vocation H that changes be made to any posted job ad’s job title, job category, location, work type, body copy or Advertiser contact details. Vocation H will only grant and make such changes to job ads in the event that incorrect or inaccurate information has been mistakenly posted.
  13. Advertisers will be invoiced by Vocation H for single ad rate advertisements at the appropriate rate after each job posting session.
  14. Advertisers will be invoiced by Vocation H for job package purchases at the appropriate rate immediately following purchase confirmation.
  15. Advertisers may choose to receive their invoices via email or regular mail services.
  16. All amounts owing to Vocation H by Advertisers must be paid within 14 days of the date of invoice notwithstanding any errors or omissions in any advertisement placed on the Vocation H Site.
  17. Vocation H will charge Advertisers a late payment fee (at the rate of $5 per month) on any overdue monies owed.
  18. Advertisers using the site are responsible for accurately maintaining the billing status of their members account.
  19. Advertisers who fail to pay invoices for use of the service may have their account suspended permanently or until owing monies have been paid and received by Vocation H.
  20. Vocation H reserves the right to cancel any Advertiser’s membership account at any time and for any appropriate reason.
  21. Vocation H reserves the right to refuse service, remove or edit content, or cancel orders made by any Advertiser at Vocation H’s sole discretion.
  22. As a condition of using services provided by Vocation H, Advertisers agree to comply with the Human Rights and Equal Opportunity Commission Act 1986 (C'th) and all anti-discrimination and equal opportunity legislation applicable in the State or Territory in which they conduct business.
  23. If an exemption to comply with the Human Rights and Equal Opportunity Commission Act 1986 (C'th) has been granted, Advertiser must include the exemption number in the job advertisement submitted to Vocation H.
  24. Vocation H will not accept advertisements that appear to be contrary to law.
  25. Vocation H reserves the right to withdraw without notice to the Advertiser any advertisement that is or appears to Vocation H to be contrary to law.
  26. Vocation H reserves the right to remove, delete or reject any advertisement from its Site for any reason whatsoever.
  27. Advertisers agree to indemnify Vocation H, its officers, employees and agents against all claims, actions, suits, liabilities, costs and expenses incurred on any account by Vocation H as a result of the listing or proposed listing of any advertisement by an Advertiser on the Site.
  28. Vocation H cannot and does not guarantee or warrant to the Advertiser that files available for downloading through the Site or delivered via electronic mail through the Site will be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties.
  29. Advertisers are responsible for implementing sufficient procedures and checkpoints to satisfy their particular requirements for accuracy of data input and output, and for maintaining a means external to the Site for the reconstruction of any lost data.
  30. Vocation H provides no warranty to Advertisers that services generally available through the Site will be uninterrupted or error free. Vocation H agrees to use reasonable endeavour to ensure that any disruptions to or a denial of access to the Site will be remedied as quickly as possible.
  31. Vocation H makes every effort to avoid errors in job advertisements it has agreed to post on the Site. However, Vocation H accepts no liability for any errors and requires that Advertisers check their advertisements for errors as soon as they are posted on the Site. All reasonable efforts will be undertaken by Vocation H to edit errors brought to our attention as soon as possible.
  32. Vocation H agrees to use every reasonable effort to publish advertisements in the shortest possible time frame. Vocation H is not liable for any loss or damage incurred by an Advertiser as a result of any failure or delay in listing an advertisement.
  33. Advertisers agree at all times to deal with any information or products provided by Vocation H or accessed from the Site in a manner which abides by all applicable laws of Australia, or of any other relevant jurisdiction (including, without limitation, privacy and copyright laws).
  34. Vocation H forbids Advertisers from using the Site for the purposes of posting job advertisements relating to any franchise, pyramid scheme, "club membership", multi-level marketing, distributorship or sales representative agency arrangement or other business opportunity which requires an up front or periodic payment, pays commissions only (no significant salary) or requires recruitment of others including, but not limited to, members, sub-distributors or sub-agents.
  35. Advertisers agree to adhere to the principles set out in the RCSA's code of Practice relating to truth in advertising.
  36. Advertisers agree to only place job ads for permanent positions for which they have permission to recruit.
  37. Advertisers agree to keep Vocation H its officers, employees and agents fully indemnified against any actual or contingent liabilities incurred in relation to any actions or claims brought by any person or entity against Vocation H as a result of an actual or alleged breach by you of any law, or such other actions or claims brought in relation to the provision of services by Vocation H to you.
  38. Advertisers may not assign or transfer any rights and obligations pursuant to this agreement to any other person or entity without the prior written approval of Vocation H (which will not be unreasonably withheld). If you are a company, any change in your effective control shall be deemed an assignment for the purpose of this clause.
  39. Advertisers agree that Vocation H retains all intellectual property rights contained in any of the goods and services provided to you by Vocation H.
  40. Advertisers acknowledge and agree that Vocation H acts as a medium through which individuals seek employment opportunities and that Vocation H does not vet nor is it responsible for vetting job candidates or the representations (whether oral or in writing) made by them.
  41. Vocation H disclaims all liability for any loss, costs, damages or loss of profits sustained as a consequence of any Advertiser employing or engaging any person sourced through the Vocation H Site.
  42. Advertisers agree to comply with the National Privacy Principles set out under the Privacy Amendment (Private Section) Act 2000 ("NPP's") See www.privacy.gov.au for more information on the Australian NPP's.
  43. Advertisers agree that pursuant to Sections 18K(1)(b) and 18N(1)(b) of the Privacy Act 1988, Vocation H may, for the purposes of assessing an Advertiser’s commercial credit application, obtain from either a credit reporting agency or other credit providers, personal credit information about the Advertiser and/or its directors.
  44. Advertisers agree that pursuant to Section 18K(1)(h) of the Privacy Act 1988, Vocation H may obtain a consumer credit report about the Advertiser from a credit reporting agency for the purposes of collecting overdue payments relating to commercial credit owed by the Advertiser.
  45. Advertisers agree to comply with section 53B of the Trade Practices Act 1974 (C'th) which requires that Advertisers that are companies not mislead persons seeking employment as to the availability, nature, terms or conditions or, any other matter relating to the employment opportunity being offered.
  46. Vocation H provides links to other Internet sites maintained by third parties. Linked sites are not under the control of Vocation H and Vocation H is not responsible for the contents (including the accuracy, legality or decency) of any linked site or any link contained in a linked site.
  47. The inclusion of any linked sites on the Vocation H site does not imply endorsement by Vocation H of the linked site. Vocation H is not responsible for the copyright compliance of any linked site. Vocation H will not be liable for any damages or loss arising in any way out of or in connection with or incidental to any information or third party service provided by any third party.
  48. While Vocation H takes due care in ensuring the privacy and integrity of the information provided by Advertisers, the possibility exists that this information could be unlawfully observed by a third party while in transit over the Internet or while stored on Vocation H’s systems or on Vocation H’s Site. Vocation H disclaims all liability to Advertisers to the greatest extent possible pursuant to law should this occur.
  49. If in Vocation H’s reasonable opinion any job posting is likely to infringe upon any of the warranties and representations in the stipulated Terms & Conditions, then Vocation H may without prejudice remove that job posting and any related information.
  50. Vocation H welcomes feedback from users about our Site. Users agree that Vocation H may reproduce or create derivative works of, and publicly display any materials and other information (including ideas for new or improved services) that users submit by email to Vocation H.
  51. Vocation H may modify this agreement at any time, and such modifications shall become effective immediately upon posting of the modified agreement on the Site.
  52. If any part of this agreement is held invalid that part shall be severed from this agreement and the remainder of this agreement will continue to be valid and enforceable.
  53. Termination of this agreement does not end those provisions that are capable of surviving the ending of this agreement.
  54. The laws governing this agreement will be the laws in Victoria, Australia and Advertisers irrevocably submit to the exclusive jurisdiction of its Courts and its Appellate Courts and the jurisdiction of the Federal Court of Australia sitting in Victoria.
  55. For the purposes of this agreement the words "Vocation H", "We", "Our" and "Us" refer to Vocation H and "Site" to materials delivered on www.vocationh.com.au .

JOBSEEKERS

  1. Copyright in the material on this Site are owned by Vocation H (ABN 57 449 019 763) ("Vocation H") unless otherwise indicated and users agree not to infringe any intellectual property rights owned by Vocation H.
  2. Vocation H gives no guarantee the continued availability of any particular job advertised on the Site and will not be liable to users should an advertiser have filled the vacancy at any time prior to removal of the advertisement from the Site.
  3. Whilst Vocation H takes efforts to ensure that jobs advertised are for actual job vacancies, no guarantees are given that every job advertisement represents an actual job vacancy.
  4. Vocation H provides links to other Internet sites maintained by third parties. Linked sites are not under the control of Vocation H and Vocation H is not responsible for the contents (including the accuracy, legality or decency) of any linked site or any link contained in a linked site.
  5. The inclusion of any linked sites on the Vocation H site does not imply endorsement by Vocation H of the linked site. Vocation H is not responsible for the copyright compliance of any linked site. Vocation H will not be liable for any damages or loss arising in any way out of or in connection with or incidental to any information or third party service provided by any third party.
  6. Vocation H provides no warranty that the services generally available through its Site will be uninterrupted or error-free or that defects in the service will be corrected.
  7. Vocation H cannot and does not guarantee or warrant that any files available for downloading through the Site or delivered via electronic mail will be free of infection, viruses, worms, Trojan horses or other code that manifest malicious or destructive properties.

  9. Users agree that information contained on this Site is for personal use only. Information on this site may not be sold or redistributed.
  10. Material may be downloaded from this Site provided it is for personal, non-commercial use only. All copyright and other proprietary notices must remain intact.
  11. Users are forbidden to use this Site for any purpose that is considered unlawful or prohibited by these Terms & Conditions of use.
  12. No modification, copying, reproducing, republishing, uploading, posting, or distribution of materials (including code and software) is allowed from this Site.
